1. Suspension - 1 Year 2. Effective September 7, 2005 The respondent was found to be in default for his failure to file an answer to the formal complaint or appear at the hearing. Based on that default, the panel found that respondent failed to file proceedings in a probate court on behalf of his client in one matter; failed to truthfully communicate the status of each of the client=s matters to them; misrepresented the status of his clients=
matters; failed to deposit money entrusted to him into an IOLTA account; failed to froward the money to his clients in a timely manner; and commingled and misappropriated monies entrusted to him.
Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.4; 1.15; 4.1; and 8.4(a)-(c).
The hearing panel ordered that respondent=s license be suspended for one year. Costs were assessed in the amount of $1,918.60.
