Effective July 9, 2005 The hearing panel found that respondent failed to notify and discuss a proposed settlement with his client and signed a final order for the sale of property without his client=s knowledge or consent. In another matter, respondent neglected a legal matter entrusted to him; failed to seek the lawful objectives of his client through reasonably available means; failed to act with reasonable diligence and promptness in representing his client; and made misrepresentations to the Attorney Grievance Commission during the investigative phase of this matter.
Respondent=s misconduct was in violation of MCR 9.104(A)(1)-(4), (6) and (7); MCR9.113(A); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 8.1(a)(1); and 8.4(a)-(c). The panel ordered that respondent be suspended for 120 days and be subject to a condition relevant to the established misconduct. Costs were assessed in the amount of $3,018.60.
