Suspension - 180 Days Effective July 29, 2005
The Grievance Administrator filed a petition on April 21, 2004 seeking entry of an order increasing discipline for respondent's failure to comply with a discipline order issued in Grievance Administrator v James P. Lavender, Case No. 03-33-GA issued November 5, 2003. At the show cause hearing, the respondent and Grievance Administrator submitted a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5) and MCR 9.121(C).
Based on the stipulation, together with the testimony of respondent, the hearing panel ordered that respondent's license to practice law be suspended for 180 days to run concurrently with the suspension ordered in Grievance Administrator v James P. Lavender, Case No. 04-113-GA, also effective July 29, 2005. The panel further ordered that respondent shall not be eligible to petition for reinstatement until he has fully complied with all the provisions of MCR 9.123(B), MCR 9.124, and MCR 9.121(E), along with the provisions in the order of suspension and restitution issued in Grievance Administrator v James P. Lavender, Case No. 04-113-GA. The panel further ordered that respondent be subject to conditions relevant to the alleged misconduct. Costs were assessed in the amount of $1,132.13.
