NOTICE OF REPRIMAND AND RESTITUTION WITH CONDITION (By Consent)

1. Reprimand 2. Effective July 2, 2005 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), containing respondent=s plea of no contest to allegations that, in child protective proceedings, failed to appear for a motion hearing and trial; failed to advise the court or the opposing attorney of his intent not to appear for the hearing or trial; and abandoned the representation. Respondent was charged with violations of MCR 9.104(A)(1)-(4); MCR 2.117(C); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 3.2; 3.4(c); and 8.4(a) and (c).
The parties agreed that respondent should be reprimanded with a condition relevant to the alleged misconduct. The parties also agreed that respondent shall pay restitution in the amount of $5,000.00. Costs were assessed in the amount of $764.64.
