Effective March 16, 2005 The hearing panel found that respondent, in a workers= compensation matter, neglected the matter by failing to file an appeal of the workers= compensation magistrate=s granting of the employer=s Petition to Stop Benefits; and failed to act with reasonable diligence in pursuit of the workers= compensation appeal. Respondent=s conduct was in violation Michigan Rules of Professional Conduct 1.1(c); 1.3 and 8.4(a).
The hearing panel ordered that respondent be reprimanded and pay restitution in the amount of $2,734.42.
Respondent filed a Apetition for rehearing@ seeking review as to the amount of restitution only. The Board remanded the matter to Tri-County Hearing Panel #8 and, before a hearing was held, respondent withdrew his petition. Costs were assessed in the amount of $5,068.13.
