NOTICE OF SUSPENSION (Pending Appeal)

Case No: 03-115-GA Notice Issued: March 4, 2005 Harvey J. Zameck, P 22687, Southfield, Michigan, by the Attorney Discipline Tri-County Hearing Panel #52.

1. Suspension - 180 Days 2. Effective March 2, 2005 The parties stipulated to the entry of an amended formal complaint and further answer in which respondent admitted the allegations that he failed to answer three requests for investigation; failed to comply with the Grievance Administrator=s written requests for information; and failed to appear at the offices of the Attorney Grievance Commission as required by a subpoena.

Additionally, respondent pled no contest to the allegations that, in a real estate matter, he failed to take any further action on behalf of his client and failed to adequately communicate with his client=s trustee. With regard to the deposition of an expert witness, respondent pled no contest to the allegations that he failed to respond to the expert=s invoices and failed to timely pay the expert. Finally, respondent pled no contest to the allegations that, in two matters, he failed to provide written notification to his clients of his suspension from the practice of law; and filed an affidavit of compliance with the Michigan Supreme Court in which he averred that he had fully complied with MCR 9.119.

Respondent admitted that his conduct was in violation of MCR 9.104(A)(1)-(4), (7) and (9); MCR 9.113(A) and (B)(2); MCR 9.119(A); and Michigan Rules of Professional Conduct 1.4(a) and (b); 8.1(a)(2); and 8.4(a) and (c).

The hearing panel ordered that respondent should be suspended for 180 days. The respondent has filed a timely petition for review which will be scheduled for hearing before the Board.
