FINAL NOTICE OF SUSPENSION (With Conditions)

Case No: 03-174-GA Notice Issued: March 22, 2005 Harvey J. Zameck, P 22687, Southfield, Michigan, by the Attorney Discipline Board affirming the order of Tri-County Hearing Panel #56.

1. Suspension - 30 days 2. Effective February 28, 2005 Respondent appeared at the public hearing but was found to be in default for failing to file an answer to the formal complaint. Based on that default, the hearing panel found that respondent issued checks in two matters as payment for court reporter services without sufficient funds to cover the checks and failed to pay the balance owed to the court reporters. Additionally, in a collection matter for the State of Arizona, respondent failed to keep his client reasonably informed of the status of the matter. Finally, respondent failed to file answers to four requests for investigation served by the Grievance Administrator.

The panel ordered that respondent=s license to practice law in Michigan be suspended for 30 days with conditions relevant to the established misconduct.

The respondent petitioned for review of the hearing panel=s order but failed to file the required brief and accordingly, the Attorney Discipline Board dismissed respondent=s petition for review. Respondent subsequently filed a motion to reinstate his petition for review which was denied by the Board.

Respondent filed an application for leave to appeal with the Supreme Court, seeking to have his petition for review reinstated before the Board and requesting that the Board=s order be stayed. On February 28, 2005, the Supreme Court issued an order denying respondent=s application for leave to appeal and his motion for stay. Total costs were assessed in the amount of $2,213.01.
