NOTICE OF SUSPENSION & RESTITUTION (With Conditions)
Case No. 04-69-GA Notice Issued: March 28, 2005 Terrell Thomas, P 54809, Detroit, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #25.
1. Suspension - 30 Days 2. Effective March 28, 2005 Based on an agreement between the parties presented at the hearing, respondent pled no contest to failing to diligently pursue one client=s QDRO; and, in two matters, failing to undertake any action on his clients= behalf; and failing to respond to his clients= reasonable requests for communication or otherwise keeping them reasonably informed regarding the status of their matters. Additionally, respondent pled no contest to failing to promptly refund the unearned portion of two retainers and failing to refund an unused filing fee.
Respondent was charged with violations of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4; and 8.4(a) and (c). The panel ordered that respondent be suspended for 30 days and pay restitution in the aggregate amount of $1,910.00. Additionally, the panel imposed conditions, relative to the alleged misconduct, which become effective upon respondent=s active reinstatement to the practice of law. Costs were assessed in the amount of $1,847.67.
