NOTICE OF SUSPENSION WITH CONDITION (Pending Appeal)

Case No. 04-02-GA Notice Issued: February 9, 2005 Richard P. Zipser, P 22747, Southfield, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #58.

2. Effective February 4, 2005

Based on respondent=s default and admissions on the record, the hearing panel found that respondent failed to comply with court orders; failed to timely and diligently prosecute a client=s matter; and failed to file an answer to a request for investigation. Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a) and (b); 8.1(a)(2); and 8.4(a)-(c).

The hearing panel ordered that respondent=s license be suspended for 180 days, with credit given for the 35 days during which the respondent was suspended during the pendency of these proceedings. The panel also ordered that respondent be subject to a condition relevant to the established misconduct.

Respondent filed timely petitions for review and stay of discipline and, on February 9, 2005, the Attorney Discipline Board denied the stay of discipline and scheduled the matter for a review hearing on April 21, 2005.

1 Respondent was given credit for the 35 days he was suspended during the pendency of this case.
