Effective January 7, 2005 The hearing panel found, after remand from the Attorney Discipline Board, that respondent=s use of a profanity directed at the presiding magistrate during a proceeding, but off the record and in the hearing room during the course of a workers= compensation proceeding, constituted Aundignified or discourteous conduct@ toward a tribunal in violation of MCR 9.104(2) and Michigan Rules of Professional Conduct 3.5(c).
The panel further found that the specific facts and circumstances presented in this case warrant the entry of an order of discipline which imposes Ano discipline@ in accordance with Grievance Administrator v Deutch, 455 Mich 149 (1997). Costs were assessed in the amount of $2,298.15.
