NOTICE OF REPRIMAND AND RESTITUTION (By Consent)

1. Reprimand 2. Effective December 22, 2004 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), containing respondent=s plea of no contest to allegations that, in a matter to file a writ of habeas corpus, he collected a clearly excessive fee to review the court file materials; failed to refund the unearned portion of the fee; neglected the representation; and failed to communicate with his client. Respondent was charged with violations of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4(a); 1.5(a); 1.16(d); and 8.4(a) and (c).
The parties agreed that respondent should be reprimanded and pay restitution in the amount of $2,000.00. Costs were assessed in the amount of $832.06.
