Effective September 24, 2004 The hearing panel found that, in a guardianship and conservatorship matter, respondent failed to execute a written fee agreement; failed to comply with a court order; failed to turn over assets and documentation relating to the assets pertinent to the administration of a guardianship and conservatorship; failed to insure that information provided to the Grievance Administrator was complete; and failed to produce documents pursuant to a subpoena issued by the Grievance Administrator.
Respondent's conduct was found to be in violation of MCR 9.104(A)(1)-(4); MCR 9.113; and Michigan Rules Professional Conduct 81.(a) and (b); and 8.4(a)-(c). The panel issued an order revoking respondent's license to practice law in Michigan and ordered restitution in the amount of $1,184.82.
Respondent filed a petition for review which was later dismissed for his failure to file a brief in support of his petition for review. On November 22, 2004, the Attorney Discipline Board denied respondent=s petition to reinstate his petition for review.
In December 2004, respondent filed a pleading with the Michigan Supreme Court requesting that the court Areverse the action of the Board in refusing a hearing and reverses this action of the Discipline Board and Panel and reinstate my license.@ The Michigan Supreme Court denied respondent=s application for leave to appeal on May 31, 2005. Total costs were assessed in the amount of $2,942.85.
