NOTICE OF SUSPENSION AND RESTITUTION (With Conditions)

1. Suspension - 60 Days 2. Effective October 7, 2004 Based on respondent=s default and admissions on the record, the hearing panel found that respondent neglected client matters; failed to communicate with his clients; failed to return unearned fees; failed to provide completely truthful information to one client; and failed to answer three requests for investigation served upon him by the Grievance Administrator.
Respondent=s conduct was in violation of MCR 9.014(A)(1)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a) and (b); 1.16; 8.1(a)(2); and 8.4(a) and (c).
The hearing panel ordered that respondent be suspended from the practice of law in Michigan for 60 days and pay restitution in the amount of $750.00. The panel also ordered that unless respondent filed proof of payment of $1,800.00 of restitution to two additional clients, the Grievance Administrator may petition for a supplemental order of restitution. Finally, the panel imposed conditions relative to the established misconduct. Costs were assessed in the amount of 1,923.32.
