NOTICE OF SUSPENSION AND RESTITUTION WITH CONDITION (By Consent)

1. Suspension - 60 Days 2. Effective September 8, 2004 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline containing respondent=s plea of no contest to the allegations that, as an
appointed attorney in a child abuse and neglect appeal, she accepted the case without being competent to handle the case; failed to consult the relevant court rules to determine the applicable procedures and deadlines for filing the appeal; failed to file the appeal; and failed to tell her client that the deadline had passed for filing an appeal.
Respondent was charged with violations of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1(a)-(c); 1.2(a); 1.3; 1.4(a) and (b); 3.2; and 8.4(a)-(c). The parties agreed that respondent should be suspended for 60 days, complete 60 hours of community service, and pay restitution in the amount of $1,000.00. Costs were assessed in the amount of $874.78.
