NOTICE OF SUSPENSION (By Consent)

1. Suspension - 3 Years 2. Effective November 2, 2004 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), containing respondent=s plea of no contest to the allegations that he practiced while suspended; neglected and failed to communicate with his clients; failed to safekeep a client=s property; failed to surrender papers to a client; failed to respond to the lawful demands of the Grievance Administrator; and failed to answer requests for investigation.
Respondent was charged with violations of MCR 9.104(A)(9); MCR 9.113(A); MCR 9.119(E); and Michigan Rules of Professional Conduct 1.1(c); 1.4(a) and (b); 1.15(a); 1.16(d); and 8.1(a)(2). The parties agreed that respondent=s license to practice law in Michigan should be suspended for three years and that respondent be subject to certain conditions, including the payment of restitution in the aggregate amount of $7,487.50, along with other conditions relevant to the alleged misconduct. Costs were assessed in the amount of $1,268.73.
