NOTICE OF SUSPENSION (By Consent)

Case No. 03-170-GA Notice Issued: June 21, 2004 William Pultusker, P 19134, Southfield, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #66.

1. Suspension - 120 Days 2. Effective August 1, 2004 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline containing respondent=s plea of no contest to the allegations that respondent,

as co-counsel for the plaintiffs in three civil suits, failed to promptly notify two of the co-counsel of his receipt of settlement monies in the three cases; endorsed or caused to be endorsed a check, in the amount of $350,000.00, without the authority or knowledge of two of the named co-counsel on the check, and then deposited this check into his bank account; and failed to promptly deliver those funds received to the appropriate co-counsel. Respondent=s conduct was alleged to be in violation of MCR

9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.15(b); and 8.4(a)-(c).

The parties agreed that respondent should be suspended for 120 days commencing August 1, 2004. Costs were assessed in the amount of $809.52.
