NOTICE OF SUSPENSION AND RESTITUTION (Pending Appeal)

Case No. 03-125-GA Notice Issued: April 27, 2004 Allan G. Meganck, P 31873, Grosse Pointe Farms, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #32.

1. Suspension - 3 Years 2. Effective April 24, 2004 Respondent appeared at the hearing but was found in default for failing to timely answer the formal complaint. Based on that default, the hearing panel found that respondent forged, or caused to be forged, false notaries on two separate mortgage deeds; and forged, or caused to be forged, a county register of deeds stamp, bearing a liber and page number, on one of those mortgage deeds. Respondent=s conduct was in violation of MCR 9.104(A)(2)-(5); and Michigan Rules of Professional Conduct 8.4(b).

The hearing panel ordered that respondent be suspended for three years and pay restitution in the amount of $71,872.00 in accordance with a previously executed promissory note. On April 16, 2004, respondent filed a motion for a stay of discipline which was denied by the Board on April 22, 2004. Respondent has filed a petition for review and the matter is currently pending before the Board.
