NOTICE OF REPRIMAND (With Conditions)
Case No. 03-45-GA Notice Issued: June 3, 2004 Carl S. Krueger, P 16266, Muskegon Heights, Michigan, by the Attorney Discipline Board Muskegon County Hearing Panel #3.
1. Reprimand 2. Effective June 2, 2004 The hearing panel found that respondent, in real estate/encroachment matter, failed to prosecute his client=s lawsuit; failed to reply to his client=s request for status of the matter; and failed to advise his client that the claim was dismissed for non-service. Respondent also knowingly failed to respond to a lawful demand for information made by the Attorney Grievance Commission; and knowingly failed to comply with the subpoena and appear under oath with the client file.
Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1(a) and (c); 1.3; 1.4(a) and (b); 8.1(a)(2); and 8.4(a) and (c). The hearing panel ordered that respondent be reprimanded with conditions relevant to the established misconduct. Costs were assessed in the amount of $2,351.21.
