NOTICE OF SUSPENSION AND RESTITUTION (With Conditions)

Case Nos. 01-69-GA; 01-121-GA; 01-167-GA Notice Issued: April 23, 2004 Charles H. Noble, P 18316, Detroit, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #14.

1. Suspension - 30 days 2. Effective April 23, 2004 The hearing panel adopted the Master=s findings that respondent, in six separate matters, neglected the cases and failed to return unearned fees. In five of those matters, respondent did not communicate with his clients; and in three of these matters, respondent failed to provide accountings or return the client file. Additionally, respondent failed to expedite one of the matters and charged an excessive fee in another. Finally, respondent failed to timely answer a request for investigation served by the Grievance Administrator; failed to respond to a number of letters from the Grievance Administrator; and failed to appear in response to a subpoena served upon him by the Grievance Administrator.

Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1(b) and (c); 1.2(a); 1.3; 1.4(a) and (b); 1.5(a); 1.15(b); 1.16(d); 3.2; 8.1(b); and 8.4(a) and (c). The hearing panel ordered that respondent=s license to practice law in Michigan be suspended for 30 days and that he pay restitution in the aggregate amount of $14,275.00. Additionally, the panel ordered that respondent subject to conditions relevant to the established misconduct. Costs were assessed in the amount of $4,448.57.
