NOTICE OF SUSPENSION Case Nos. 04-32-JC; 04-33-GA Notice Issued: June 17, 2004 Mark J. Anstey, P 43678, Bridgman, Michigan, by the Attorney Discipline Board Berrien County Hearing Panel #1.

1. Suspension - 18 Months 2. Effective June 17, 2004

Based on the parties= agreement, the hearing panel found that respondent abandoned the representation of a probate matter; and, in a real estate adverse possession matter, failed to appear at mediation and a show cause hearing; failed to provide notice to his client, the court, and opposing counsel of his intent not to appear; failed to file a mediation brief as ordered; failed to file an evaluation brief; and failed to pay sanctions to the mediator and opposing counsel. Respondent also failed to file an answer to a request for investigation served by the Grievance Administrator. Additionally, respondent was convicted of operating a motor vehicle while visibly impaired under the influence of intoxicating liquor, in violation of MCL 257.625(3); and violating the terms of his probation twice by consuming alcohol.

Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1(b) and (c); 1.2(a); 1.3; 1.4; 3.2; 3.4(c); 8.1(a)(2); and 8.4(a)-(c)

The hearing panel ordered that respondent=s license be suspended for 18 months and assessed costs in the amount of $1,799.48.
