NOTICE OF REVOCATION AND RESTITUTION Case No. 03-125-GA Notice Issued: January 11, 2005 Allan G. Meganck, P 31873, Grosse Pointe Farms, Michigan, by the Attorney Discipline Board increasing Tri-County Hearing Panel #32's order of discipline from a three year suspension to revocation.

1. Revocation 2. Effective April 24, 2004 Respondent appeared at the hearing but was found in default for failing to timely answer the formal complaint. Based on that default, the hearing panel found that respondent forged, or caused to be forged, false notaries on two separate mortgages; and forged, or caused to be forged, a county register of deeds stamp, bearing a liber and page number, on one of those mortgages. Respondent=s conduct was in violation of MCR 9.104(A)(2)-(5); and Michigan Rules of Professional Conduct 8.4(b).

The hearing panel ordered that respondent be suspended for three years and pay restitution in the amount of $71,872.00 in accordance with a previously executed promissory note. On April 16, 2004, respondent filed a motion for a stay of discipline which was denied by the Board on April 22, 2004. Respondent filed a timely petition for review and the Grievance Administrator filed a cross-petition for review.

Respondent failed to appear at the review hearing and the Board dismissed his petition, but proceeded with the Grievance Administrator=s petition. Upon review, the Board vacated Tri-County Hearing Panel #32's order of suspension and increased discipline to a revocation of respondent=s license to practice law. The Board also ordered that respondent pay $71,872.00 in restitution and assessed costs in the amount of $1,854.28.
