NOTICE OF SUSPENSION AND RESTITUTION Case No. 02-49-MZ (Ref 00-47-GA; 01-92-GA)

Notice Issued: January 28, 2004 Robert L. Harley, Jr., P-30166, Rockford, Michigan, by the Attorney Discipline Board Kent County Hearing Panel #2.

1. Suspension - 240 days; 2. Effective January 16, 2004 1 The Grievance Administrator filed two petitions seeking an increase in discipline for respondent=s failure to comply with the prior orders of discipline entered in Grievance Administrator v Robert L. Harley, Jr., Case No. 00-47-GA; and Grievance Administrator v Robert L. Harley, Jr., Case No. 01-92-GA. Based on respondent=s acknowledgment that he had failed to comply with the prior orders, the panel found that respondent had committed misconduct, in violation of MCR 9.104(9).

The hearing panel ordered that respondent's license to practice law be suspended for an additional 240 days, effective upon the date respondent pays the $3,500.00 in restitution. On January 16, 2004, respondent paid the $3,500.00 restitution and his suspension is deemed to be effective on that date. Costs were originally assessed in the amount of $248.02 and now stand at $261.91 due to the assessment of statutory interest.

1 Respondent was previously suspended for 30 days, effective January 14, 2002, and for one year, effective December 12, 2002. Respondent=s license to practice law in Michigan has been continuously suspended since January 14, 2002. See Notice of Suspension and Restitution, dated February 12, 2002.
