NOTICE OF SUSPENSION AND RESTITUTION Case No. 03-131-GA Notice Issued: January 27, 2004 Thomas J. Fayfer, P 40754, Ann Arbor, Michigan, by the Attorney Discipline Board Livingston County Hearing Panel #1.

1. Suspension - 1 Year 2. Effective January 14, 2004 Based on respondent=s default for failure to file an answer to the formal complaint and failure to appear at the public hearing, the hearing panel found that respondent neglected a legal matter; failed to keep his client reasonably informed concerning the status of the matter; failed to refund unearned fees; abandoned the representation; and failed to answer a request for investigation served by the Grievance Administrator. Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4) and (7); MCR 9.113(A); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 1.1(a) and (c); 1.3; 1.4(a); 1.16(d); 8.1(a)(2); and 8.4(a) and (c).

The hearing panel ordered that respondent=s license be suspended for one year, to run consecutively to a 180 day suspension imposed in Grievance Administrator v Thomas J. Fayfer, Case No. 02-153-GA. The panel also ordered that respondent pay restitution in the amount of $1,000.00. Costs were assessed in the amount of $1,757.16.
