Effective January 8, 2004 Based on respondent=s admission to all of the allegations in the formal complaint, the hearing panel found that respondent had failed to deposit judgment funds into an IOLTA or other trust account; failed to notify the client of his receipt of the judgment funds; commingled the client=s funds by depositing them into his personal account; misappropriated the judgment funds; and falsely procured funds from the general checking account of his employer via forged checks.
Respondent=s conduct was in violation of MCR 9.104(A)(1)-(5); Michigan Rules of Professional Conduct 1.15(a), (b), and (d); 3.4(c); and 8.4(a)-(c); and MCL 750.248 and MCL 750.356. The hearing panel ordered that respondent=s license to practice law in Michigan be revoked and assessed costs in the amount of $1,786.12.
