NOTICE VACATING TRANSFER TO INACTIVE STATUS (Pending Appeal)
Case No. 01-62-GA Notice Issued: October 28, 2003 Alphonse Lewis, Jr., P 16624, Grand Rapids, Michigan, by the Attorney Discipline Board, vacating Kent County Hearing Panel #6's order transferring respondent to inactive status.
The hearing panel found that, within the meaning of MCR 9.121(B), respondent was incapacitated and ordered that respondent be transferred to inactive status pursuant to MCR 9.121(B)(3) for an indefinite period, and until further order of the Attorney Discipline Board. Pursuant to MCR 9.121(B)(4), pending disciplinary proceedings against the respondent were held in abeyance.
Respondent filed a timely petition for review and motion for stay of discipline. The Attorney Discipline Board granted the motion for stay of discipline on an interim basis pending further consideration. After considering respondent=s motion together with the response filed by the Grievance Administrator, the Attorney Discipline Board dissolved the interim stay, effective July 16, 2003.
On October 3, 2003, the Attorney Discipline Board vacated the hearing panel=s order transferring respondent to inactive status and remanded the matter to the hearing panel for completion of the hearing on misconduct. Respondent=s disqualification from the practice of law is deemed to have commenced on July 16, 2003 and to have continued until October 25, 2003, the effective date of the Board=s order.
