NOTICE OF REPRIMAND WITH CONDITIONS (By Consent)

Case No. 19-129-GA Notice Issued: April 3, 2020 Daniel Joseph Marchese, P 75872, Rochester, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #61.

Reprimand, Effective April 1, 2020 Respondent and the Grievance Administrator filed a Stipulation for Consent Order of Discipline, in accordance with MCR 9.115(F)(5), which was approved by the Attorney Grievance Commission and accepted by the hearing panel. The stipulation contained respondent’s plea of no contest to the allegations that he committed acts of professional misconduct by violating an Amended Stipulation for Contractual Probation and a Second Amended Stipulation for Contractual Probation he entered into with the Attorney Grievance Commission.

Based upon respondent’s plea of no contest and the stipulation of the parties, the panel found that respondent engaged in conduct involving violation of a criminal law where such conduct reflects adversely on the lawyer’s honest, trustworthiness, or fitness as a lawyer, in violation of MRPC 8.4(b); and failed to comply with the terms of his contractual probation, in violation of MCR 9.114(C)(4)(a). Respondent was also found to have violated MCR 9.104(2) and (3).

In accordance with the stipulation of the parties, the hearing panel ordered that respondent be reprimanded and subject to conditions relevant to the established misconduct. Costs were assessed in the amount of $770.34.
