NOTICE OF PROBATION AND RESTITUTION (By Consent)

Case No. 02-150-GA Notice Issued: September 19, 2003 R. Dillon McCormick, P 44010, Lansing, Michigan, by the Attorney Discipline Board Ingham County Hearing Panel #7.

1. Probation - 1 Year 2. Effective September 19, 2003 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), containing respondent=s admission that in a workers= compensation matter, he failed to obtain the deposition of a medical doctor to support his client=s claim prior to the trial date; failed to request an adjournment of the trial date until the day before the trial; failed to appear at a hearing; failed to file an appellate brief which resulted in a dismissal of his client=s appeal; and failed to advise his client of the unfavorable hearing opinion and dismissal of her appeal. Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a) and (b); 3.2; and 8.4(a) and (c).

The parties agreed that respondent should be placed on probation for a period of one year pursuant to MCR 9.121(C)(1). The parties also agreed that respondent should pay restitution in the amount of $7,500.00. Costs were assessed in the amount of $760.22.
