The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), containing respondent=s plea of no contest to the allegations that in a probate matter, he failed to close the estate after the statute of limitations for the potential wrongful death matter had expired; continued to file Annual Accounts listing the potential cause of action for wrongful death as an asset of the estate after the statute of limitations had expired; and failed to communicate the status of the matter to his client or otherwise reasonably communicate with her. Respondent was charged with violations of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4(a); and 8.4(a) and (c). The parties further agreed that respondent=s license to practice law in Michigan should be suspended for 30 days effective September 6, 2003. Costs were assessed in the amount of $804.14.
In accordance with MCR 9.123(A), the suspension was terminated with the respondent's filing of an affidavit of compliance with the clerk of the Michigan Supreme Court on October 7, 2003.
