1. Suspension - 1 Year 2. Effective August 5, 2003 The hearing panel found that respondent, in two separate matters, neglected those matters; failed to return unearned fees; and failed to deposit the advanced fees into trust accounts. Further, respondent failed to obey the order of a tribunal by failing to pay a default judgment; and failed to file an answer to a request for investigation served by the Grievance Administrator. Respondent=s conduct was found to be in violation of MCR 9.104(A)(1)-(4) and (7); 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.15(b); 1.16(d); 3.4(c); 8.1(b); and 8.4(a)-(c). The hearing panel ordered that respondent=s license to practice be suspended for one year and that he pay restitution in the aggregate amount of $1,549.00.
Respondent filed motion for a partial stay of discipline which was denied by the Attorney Discipline Board on August 5, 2003. Simultaneously, respondent filed a delayed motion for reconsideration which was denied by the hearing panel on August 28, 2003.
