The hearing panel found, by default, that respondent, in a civil matter, failed to file a complaint or any pleadings on behalf of his client; abandoned his client=s mater; failed to return his client=s file; and failed to return the unearned $1,500.00 retainer. Respondent also failed to file an answer to a request for investigation served by the Grievance Administrator. Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a) and (b); 1.5(a); 1.16(d); 8.1(a)(2); and 8.4(a)-(c).
The hearing panel ordered that respondent=s license be suspended for 180 days and that he pay restitution in the amount of $1,500.00 and return the client=s file. Costs were assessed in the amount of $1,765.56.
