NOTICE OF PROBATION AND RESTITUTION (By Consent)

Case No. 02-107-GA Notice Issued: August 19, 2003 Patrick J. Devlin, P 12729, Grand Rapids, Michigan, by the Attorney Discipline Board Kent County Hearing Panel #1.

1. Probation - 24 Months 2. Effective August 15, 2003 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), containing respondent=s plea of no contest to the allegations that, in two matters, he failed to communicate with his clients; failed to provide his clients with their files or surrender any other papers to them; and failed to refund the unearned portion of attorney fees. In one of the matters, respondent was also alleged to have failed to file a lawsuit on behalf of his client. Respondent's conduct was in violation of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a) and (b); 1.5(b); 1.16(a) and (d); 3.2; and 8.4(a) and (c).

The parties agreed that respondent should be placed on probation for a period of 24 months pursuant to MCR 9.121(C)(1). The parties also agreed that respondent should pay restitution in the aggregate amount of $5,000.00. Costs were assessed in the amount of $1,059.37.
