NOTICE OF SUSPENSION (By Consent)

Case No. 03-6-GA Notice Issued: July 2, 2003 Kathleen Flynn, P 32020, Warren, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #104.

1. Suspension - 180 Days 2. Effective July 1, 2003

The Grievance Administrator and respondent filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5) containing respondent=s plea of no contest to the allegations that respondent, in a conservator matter, failed to file a supplemental brief prior to March 12, 1999 and failed to file an affidavit with her motion for rehearing explaining why she failed to file a supplemental brief prior to March 12, 1999. The stipulation also contained respondent=s admissions that she failed to file an answer to a request for investigation served by the Grievance Administrator; and, in a personal injury matter, that she failed to advise her client that his deposition was re-scheduled; failed to appear for the deposition and/or advise opposing counsel that neither she or her client would be present; failed to advise her client of, and respond to, the July 17, 2000 motion to dismiss filed by opposing counsel; and failed to advise her client that an order was entered dismissing the case with prejudice.

Respondent was charged with violations of MCR 9.104(A)(1)-(4) and (7); MCR 9.113(A); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 1.1(a) and (c); 1.3; 1.4(a) and (b); 3.2; 8.1(a)(2); and 8.4(a) and (c). The parties agreed that respondent=s license to practice law in Michigan should be suspended for 180 days. Costs were assessed in the amount of $766.02.
