NOTICE OF SUSPENSION WITH CONDITIONS (By Consent)

Case Nos. 03-49-GA; 04-34-GA Notice Issued: July 15, 2005

1. Suspension - 60 Days 2. Effective May 31, 2003 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline containing respondent=s plea of no contest to the allegations that he failed to file a motion for substitute service in one matter; delayed in handling a second matter; and while the fee paid to him in a third matter has been refunded in full, he failed to promptly refund an unearned portion. Respondent was charged with violations of Michigan Rules of Professional Conduct 1.3 and 1.16(d).

The parties agreed that respondent should be suspended for 60 days, retroactive to May 31, 2003, and that, due to the retroactive nature of this discipline, respondent is not subject to the requirements of MCR 9.119 and MCR 9.123(A). The parties further agreed that respondent shall be subject to conditions relevant to the alleged misconduct. Costs were assessed in the amount of $1,488.97.
