NOTICE OF REPRIMAND AND RESTITUTION (By Consent)
Case No. 02-125-GA Notice Issued: May 6, 2003 Richard P. Zipser, P 22747, Farmington Hills, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #56.
1. Reprimand; 2. Effective May 6, 2003 The hearing panel found, by default, that respondent, in an appeal, failed to file the appeal brief; and failed to respond to two orders to show cause issued by the 8 th Circuit Court of Appeals. Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 3.2; and 8.4(a) and (c).
The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), containing the agreement of the parties that respondent should be reprimanded and pay restitution in the amount of $5,000.00. Costs were assessed in the amount of $884.16.
