NOTICE OF REVOCATION Case No. 03-14-GA Notice Issued: March 12, 2004 David E. Fregolle, P 37832, Southfield, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #82.

1. Revocation 2. Effective June 11, 2003. Based on respondent=s admission, the hearing panel found that respondent, in a possible medical malpractice action, had his notary notarize the signatures of two doctors on affidavits of merit when he knew his notary did not witness the signatures as they were made; attached the false and improperly notarized affidavits to the medical malpractice complaint filed on his client=s behalf; and filed a witness list indicating that the two doctors were his client=s expert witnesses, although neither doctor, as listed, existed and the real doctors had not reviewed any documentation regarding his client.

Respondent=s conduct was in violation of MCR 2.114(D) and MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 3.3(a)(1) and (4); 5.3(b) and (c)(1); and 8.4(a)-(c). The hearing panel ordered that respondent=s license to practice law in Michigan be revoked retroactively to June 11, 2003, to run concurrently with the revocation imposed in Grievance Administrator v David E. Fregolle, Case No. 00-132-GA. Costs were assessed in the amount of $895.58.
