NOTICE OF SUSPENSION AND RESTITUTION Case No. 02-61-GA Notice Issued: April 30, 2003 Randall J. Layman, P-53041, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #68.

1. Suspension - 180 Days; 2. Effective April 30, 2003. The hearing panel found, by default, that respondent, in a civil action, neglected his client=s matter causing a default judgment of $87,591.87 to be entered against his client; failed to comply with court orders requiring him to file responsive pleadings, comply with discovery, and/or personally pay sanctions; failed to respond to the court=s show cause order and failed to appear in court pursuant to the show cause order. Additionally, respondent failed to expedite his client=s litigation; failed to keep his client reasonably informed of the status of his matter; and failed to advise his client of the default judgment against him.

Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1(a) and (c); 1.2(a); 1.3; 1.4(a) and (b); 3.2; 3.4(c); and 8.4(a) and (c). The hearing panel ordered that respondent's license to practice law be suspended for 180 days and that he pay restitution to the complainant. Costs were assessed in the amount of $715.26.
