CORRECTED NOTICE OF REPRIMAND* (By Consent)
Case No. 02-102-GA Notice Issued: April 28, 2003 Jon R. MacDonald, P 40161, West Branch, Michigan, by the Attorney Discipline Board Clare County Hearing Panel #1.
1. Reprimand; 2. Effective April 12, 2003; The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), containing respondent=s admission to the allegations that he failed to file answers to the plaintiff=s request for interrogatories, documents and admissions on behalf of his clients; failed to advise his clients that he did not file answers to the plaintiff=s request for interrogatories, documents and admissions; and failed to advise his clients that the plaintiff had filed a motion for summary disposition and that a hearing was scheduled on the motion.
Respondent was charged with violations of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4(a) and (b); 3.2; and 8.4(a) and (c). The parties agreed that respondent should be reprimanded and pay restitution in the amount of $4,300.00. Costs were assessed in the amount of $769.52.
