NOTICE OF REPRIMAND (By Consent)
Case No. 02-102-GA Notice Issued: April 14, 2003 Jon R. MacDonald, P 40161, West Branch, Michigan, by the Attorney Discipline Board Clare County Hearing Panel #1.
1. Reprimand; 2. Effective April 12, 2003; The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), containing respondent’s admission to the allegations that he failed to file answers to the plaintiff’s request for interrogatories, documents and admissions on behalf of his clients; failed to advise his clients that he did not file answers to the plaintiff’s request for interrogatories, documents and admissions; and failed to advise his clients that the plaintiff had filed a motion for summary disposition and that a hearing was scheduled on the motion.
Respondent was charged with violations of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4(a) and (b); 3.2; and 8.4(a) and (c). The parties agreed that respondent should be reprimanded and pay restitution in the amount of $4,300.00. Costs were assessed in the amount of $769.52.
