The Grievance Administrator filed a petition on June 25, 2003 seeking entry of an order increasing discipline for respondent's failure to comply with the hearing panel's order of September 6, 2002. The respondent did not file an answer nor did he appear at the show cause hearing held on February 18, 2004. Based upon the evidence submitted by the Grievance Administrator, the panel concluded that respondent, in violation of MCR 9.104(A)(9), had not complied with its previous order.
The hearing panel ordered that respondent's license to practice law be suspended for three years, effective March 27, 2003. The panel further ordered that respondent shall not be eligible to petition for reinstatement until he has fully complied with all the provisions of the order of suspension and restitution in the matter of Grievance Administrator v Lonzo Mallette, Jr., Case Nos. 01-72-GA; 01-147-GA. Costs were assessed in the amount of $1,730.59.
