NOTICE OF REPRIMAND AND RESTITUTION (By Consent)
Case No. 00-190-GA Notice Issued: April 8, 2003 Raymond A. MacDonald, P 16918, Utica, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #106.
1. Reprimand; 2. Effective April 8, 2003; The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), containing respondent=s plea of no contest to the allegations that he failed to return an unearned fee; and, in a bankruptcy matter, failed to notify his client of a court date; failed to respond on his client=s behalf to the trustee=s motion to dismiss the bankruptcy petition; and failed to respond to his client=s requests for information regarding the status of his matter and failed to keep his client informed about the status of his bankruptcy matter.
Respondent was charged with violations of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a); 1.5(a); 1.15(b); 1.16(d); and 8.4(a) and (c). The parties agreed that respondent should be reprimanded and pay restitution in the aggregate amount of $787.00. Costs were assessed in the amount of $1,089.18.
