NOTICE OF SUSPENSION (By Consent)
Case No. 02-57-GA Notice Issued: March 26, 2003 James M. Joyce, P-28276, Grand Rapids, Michigan, by the Attorney Discipline Board Kent County Hearing Panel #4.
1. Suspension - 90 days; 2. Effective March 1, 2003. The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), containing respondent=s plea of nolo contendere to the allegations that he failed to timely file an application for leave to appeal with the Michigan Supreme Court; failed to inform his client that he had not filed the application for leave to appeal; and made a statement to his client that the Michigan Supreme Court had declined to hear the case, knowing that statement was false. Respondent was charged with violations of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3: 1.4(a) and (b); 4.1; and 8.4(a)-(c). The parties agreed that respondent should be reprimanded. Costs were assessed in the amount of $9.72.
