The hearing panel found, by default, that respondent, in a divorce matter, neglected the matter after filing an answer on behalf of his client; misappropriated monies given for an appraisal; and failed to refund unearned fees. In a guardianship matter and subsequent probate matter, respondent neglected the matter by failing to file an appearance or initiate any action on his client=s behalf. Respondent also failed to advise his client that he would take no further action on her behalf; and failed to refund the full amount of unearned fees. Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1(a)-(c); 1.2(a); 1.3; 1.4(a) and (b); 1.15(a); 1.15(a); 1.16(d); and 8.4(a)-(c).
The hearing panel ordered that respondent=s license be suspended for 180 days and that he pay restitution in the aggregate amount of $1,301.00. Costs were assessed in the amount of $1,762.52.
