NOTICE OF SUSPENSION WITH CONDITION Case No. 00-200-GA Notice Issued: February 26, 2003 Brian D. Albritton, P-46197, Bloomfield Hills, Michigan, by the Attorney Discipline Board vacating the order of Tri-County Hearing Panel #70.

Effective February 22, 2003.

The hearing panel ordered that respondent should be reprimanded for failing to promptly notify his clients of his receipt of settlement monies; failing to promptly deliver the settlement monies; misappropriating the settlement monies; and failing to file an answer a request for investigation. Respondent=s conduct was found to be in violation of MCR 9.104(1)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.4; 1.15(a)-(c); 8.1(b); and 8.4(a)-(c).

The Grievance Administrator filed a petition for review seeking an increase in the level of discipline. The Board conducted review proceedings under MCR 9.118 and, on May 14, 2002, issued an order and opinion vacating the hearing panel=s order of reprimand, increasing the discipline to a 90 day suspension, and imposing a condition relevant to the established misconduct. On June 5, 2002, the respondent filed an application for leave to appeal with the Supreme Court. Respondent=s suspension was automatically stayed pending the decision from the Supreme Court. On January 31, 2003, the Supreme Court denied respondent=s application and extended the stay of discipline for 21 days. Total costs assessed were $1,005.16.
