CORRECTED NOTICE OF SUSPENSION AND RESTITUTION* (By Consent)
Case No. 02-55-GA Notice Issued: February 19, 2003 Richard C. Littlefield, P 32222, Southfield, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #63.
1. Suspension - 60 days; 2. Effective February 12, 2003. The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), containing the respondent's plea of no contest to the allegations in Count One, paragraph 10(c), and Counts Two and Three, specifically, that respondent failed to respond to a client=s calls and letters; failed to inform his client of the status of his matter; abandoned the representation of his client=s matter; and failed to return an unearned fee. Additionally, respondent failed to file an answer to a Request for Investigation served by the Grievance Administrator; failed to appear pursuant to a personally served subpoena; and failed to produce a copy of the client=s file as required by the subpoena.
Respondent was charged with violations of MCR 9.104(A)(1)-(4); MCR 9.113(A); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4; 1.16(d); 3.2; 8.1(a)(2); and 8.4(a)-(c). The parties agreed that respondent should be suspended for 60 days and pay restitution in the amount of $750.00. The parties also agreed that paragraphs 10(a) and (b) of Count One be dismissed. Costs were assessed in the amount of $63.31.
