NOTICE OF SUSPENSION AND RESTITUTION Case Nos. 02-103-GA; 02-143-FA Notice Issued: February 21, 2003 Robert L. Harley, Jr., P-30166, Rockford, Michigan, by the Attorney Discipline Board Kent County Hearing Panel #2.

1. Suspension - 1 Year; 2. Effective December 2, 2002. The hearing panel found, by default, that respondent failed to take action on his client=s behalf; failed to prepare for trial; and failed to maintain reasonable communications with his client or return his client=s telephone calls. Respondent also failed to comply with a subpoena to produce a client=s file; and failed to file an answer to a formal complaint served by the Grievance Administrator. Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4) and (7); and Michigan Rules of Professional Conduct 1.1(a)-(c); 1.2(a); 1.3; 1.4(a); 3.2; 8.1(a)(2); and 8.4(a) and (c).

The hearing panel ordered that respondent's license to practice law be suspended for one year and that respondent pay restitution in the amount of $935.00. Costs were assessed in the amount of $1,771.09.
