The hearing panel found, by default, that respondent failed to appear on a client=s behalf; failed to adequately communicate with his client; made improper charges on his invoice to his client; and failed to refund the unearned fee. Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct1.1(c); 1.2(a); 1.3; 1.4; 1.5(a); 3.2; and 8.4(a)-(c). The panel ordered that respondent be suspended for 30 days, to run concurrently with the revocation ordered in Grievance Administrator v Darryl P. Mitchell, Case Numbers 01-73-AI; 02-50-JC. Respondent was also ordered to pay restitution in the amount of $1,500.00, and costs in the amount of $601.82.
