Effective November 27, 2002.
The hearing panel found, by default, that respondent neglected client matters; failed to communicate with his clients; failed to return files and documents to his clients; failed to refund unearned fees; made misrepresentations regarding that status of a legal matter; failed to answer requests for investigation; and failed to answer a formal complaint. Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4) and (7); MCR 9.113(A); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 1.2(a); 1.3; 1.4(a); 1.15(b); 1.16(d); and 8.4(a) and (c).
The hearing panel ordered that respondent=s license be suspended for two years and that he pay restitution in the aggregate amount of $3,800.00. The panel also imposed conditions relevant to the established misconduct and assessed costs in the amount of $353.74.
