NOTICE OF REVOCATION AND RESTITUTION Case No. 02-72-GA Notice Issued: September 17, 2003 Leodis Elliott, P 31365, Detroit, Michigan, by the Attorney Discipline Board affirming Tri-County Hearing Panel #21's order of revocation.
1. Revocation; 2. Effective January 30, 2003. The hearing panel found that respondent failed to seek his clients= legal objectives; failed to provide timely information; failed to refund unearned fees; failed to segregate unearned fees; and failed to file timely answers to two requests for investigation.
Respondent's conduct was found to be in violation of MCR 9.104(1)-(4) and (7); MCR 9.113(A); MCR 9.113(B); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a); 1.15(a) and (b); 1.16(d); 3.2; 3.4(c); 8.1(a)(2); and 8.4(a) and (c). The panel issued an order revoking respondent's license to practice in Michigan and ordered restitution in the amount of $350.00.
Respondent filed a petition for review which was granted by the Attorney Discipline Board. Respondent also filed a motion for stay of discipline which was denied by the Board on February 4, 2003. On July 15, 2003, the Attorney Discipline Board issued its order affirming the hearing panel=s order of revocation and restitution. Respondent filed a delayed motion for reconsideration which was denied by the Attorney Discipline Board on August 25, 2003. Costs were assessed in the amount of $573.18.
