NOTICE OF SUSPENSION AND RESTITUTION Case No. 02-44-GA Notice Issued: September 11, 2002 Philip L. Dulmage, P-13009, Flint, Michigan, by Attorney Discipline Board Genesee County Hearing Panel #4.

Effective September 11, 2002. 1 The panel found, by default, that respondent neglected client matters; failed to appear at scheduled court appearances; failed to communicate with his clients; failed to refund unearned fees; misrepresented the status of his clients' legal matters; failed to answer requests for investigation served by the Grievance Administrator; and failed to meet the notice and affidavit requirements of MCR 9.119 in connection with an earlier discipline matter. Respondent's conduct was in violation of MCR 9.104(A)(1)-(4), (7) and (9); MCR 9.113(A) and (B)(2); MCR 9.119(A) and (C); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4(a) and (b); 1.16(d); 3.2; 3.4(c); 8.1(b); and 8.4(a)-(c).

The panel ordered that respondent's license be suspended for three years and that he pay restitution in the aggregate amount of $1,500.00. Costs were assessed in the amount of $407.37.
