1. Suspension - 180 Days. 2. Effective July 10, 2002. The hearing panel found, by default, that respondent failed to place an unearned fee into an IOLTA or client trust account and misappropriated the funds. Respondent's conduct was found to be in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.15(a) and (d), and 8.4(a)-(c). The panel ordered that respondent's license to practice law be suspended for 180 days and assessed costs in the amount of $423.52
The respondent filed a delayed petition for review which was dismissed by the Attorney Discipline Board for respondent's failure to file a statement of facts explaining the delay in filing the petition for review.
